"Is our session being recorded?"
Yes, but only temporarily. The recording creates a summary note for your provider, and then the audio is permanently deleted. Think of it like a voicemail that's transcribed and then erased. No one can listen to it afterward.
"What if I don't want to be recorded?"
That's completely your choice. Just let your provider know, and they won't use the tool for your session. You can change your mind at any time, whether that means opting in later or opting out after trying it. It will never affect your care.

Your provider uses JotPsych, an AI-powered clinical documentation tool developed by SmartScribe Corp. JotPsych creates clinical notes from the conversation between you and your provider during appointments. The primary purpose of this technology is to allow your provider to focus on you rather than note-taking, while still maintaining accurate and timely documentation.

How Your Data Is Used
  • Documentation: JotPsych creates clinical notes based on your session conversation. These notes are reviewed and edited by your provider before becoming part of your medical record.
  • Quality Improvement: De-identified transcripts may be reviewed by JotPsych to improve the accuracy and quality of the documentation tool. No audio is retained for this purpose.
  • Compliance: SmartScribe Corp and your healthcare provider comply with all applicable federal, state, and local laws and regulations, including HIPAA, in the collection, use, and disclosure of your information.
Audio Recording & Deletion

Audio from your session is temporarily recorded to generate a clinical note. Immediately after transcription is complete, the audio recording is permanently and irreversibly deleted. No audio is ever stored, retained, or accessible after this point.

What JotPsych Will Not Do

JotPsych does not make clinical decisions, diagnose conditions, or replace your provider's professional judgment. It is a documentation tool only. Your provider reviews and approves all notes before they become part of your record.

Privacy & Data Security

All data collected and processed by JotPsych is protected with 256-bit encryption in transit and at rest, handled in accordance with HIPAA regulations, and stored in HIPAA-compliant infrastructure. SmartScribe Corp maintains a Business Associate Agreement (BAA) with your healthcare provider.

Your Rights

You have the right to withdraw your consent to the use of JotPsych at any time by notifying your healthcare provider. Withdrawal of consent will not affect the quality or availability of your care. Notes created prior to withdrawal will remain part of your medical record as with any clinical documentation.

Frequently Asked Questions

For Clinicians

While requirements vary by state and practice setting, obtaining informed consent for the use of any recording or AI-assisted tool is a clinical best practice and is required by most licensing boards. We strongly recommend always obtaining written consent, both for ethical practice and liability protection.

Yes. Many clinicians add a JotPsych consent section to their existing informed consent or intake paperwork. Others prefer a standalone form for clarity. Either approach works. The downloadable template above is designed to work both ways.

That is entirely their right. Simply proceed with your session without using JotPsych. You can revisit the conversation at a later time if the client is interested. Refusal should never affect the clinical relationship or quality of care.

The same consent form covers both in-person and telehealth sessions. JotPsych processes audio the same way regardless of modality. However, if your state requires separate telehealth consent, you may want to include a note that JotPsych may be used during telehealth appointments as well.

For clients under 18, consent must be obtained from a parent or legal guardian. The sample consent form above includes a parent/guardian signature section. Follow your state's laws regarding the age at which minors can consent to their own treatment, as this may apply to AI documentation consent as well.

Yes. Clients can revoke their consent at any time, verbally or in writing. Once revoked, simply stop using JotPsych for that client's sessions going forward. Notes already created and finalized remain part of the medical record, as with any clinical documentation.

Audio is permanently deleted immediately after transcription. De-identified transcripts may be reviewed on an ad hoc basis for quality assurance and accuracy improvement. No client-identifiable data is used for AI training purposes. This is disclosed in the consent form language above.
